Data processing principles

In beCreatives business operations, we are guided by the following data processing principles:

Lawfulness, fairness and transparency. Personal data shall be processed lawfully, fairly and in a transparent manner in relation to the data subject.

Purpose limitation. Personal data shall be collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes; further processing for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes shall not be considered to be incompatible with the initial purposes.

Data minimisation. Personal data shall be adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

Accuracy. Personal data shall be accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay.

Storage limitation. Personal data shall be kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed; personal data may be stored for longer periods insofar as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes subject to implementation of the appropriate technical and organisational measures required to safeguard the rights and freedoms of the data subject.

Integrity and confidentiality. Personal data shall be processed in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures.

Accountability. We are responsible for following, and for competence to demonstrate compliance with, the above mentioned principles.

We take the security of your personal information seriously and employ industry-standard / reasonable security measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is not completely secure. Please be aware that there is still always a risk of unauthorized access to your information.

General provisions

The data controller of your personal data is Bcreatives, UAB, a limited liability company established and operating under the laws of the Republic of Lithuania, having its legal entity code 306321350 and its office address at Kintų st.11, Vilnius 09301, Republic of Lithuania. The data controller is further referred to as “We”, “Us” or “beCreatives”.

Where this Privacy Policy refers to data recipients, the BeCreatives Group includes B.E. CREATIVES LLC a limited liability company established and operating in the USA, having its legal entity code 83-3620888, and its registered office address at 690 S Highway 89, Suite 201, Box 7414,  Jackson, WY 83002, United States of America.

This Privacy Policy applies to the online platform “beCreatives” (“Website”) that is found here: https://becreatives.co/ 

This Privacy Policy applied to the creative management platform (“Platform”) (such as SPACE or other if used by us), i.e. a software solution designed to streamline the workflow between us and our clients. 

This Policy has been prepared in accordance to the Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter – the GDPR). The notions used in this Policy shall be understood as defined in the GDPR. 

Regarding the transfer of personal data between us and you, and between us and any data recipients, we adhere to the principles of the California Consumer Privacy Act of 2018 (“CCPA“), a landmark piece of legislation that has significantly influenced data privacy standards in the United States. 

For transfers of personal data from the European Union to the United States, we comply with the relevant provisions of the Trans-Atlantic Data Privacy Framework, which replaced the Privacy Shield mechanism to safeguard such transfers. 

Certain services on our Website are offered by third-party suppliers. When you use these services, the data protection regulations that govern third-party suppliers will then apply in addition to this data protection statement. Prior to your use of such services, the third-party suppliers may require you to provide permission under the data protection law.

This Privacy Policy provides information about how we collect, use, and protect your personal data. It is not part of the Terms and Conditions and does not create any contractual obligations. References to the Terms and Conditions within this Privacy Policy are for informational purposes related to data processing activities necessary for the performance of our services, as permitted by applicable law, including Article 6(1)(b) of the GDPR.

As our services are constantly evolving, we reserve the right to change this Privacy Policy at any time subject to the applicable regulations. Any changes will be published promptly on this page. You should, nevertheless, check this page regularly for any updates.

What, Why and How?

The services offered by us via the Website can function only if we collect, store, transfer, delete and/or otherwise use (“collect and use”) specific data relating to you (“personal data” or “data”). If you do not agree with the processing of your personal data as described in this Privacy Policy, please do not use our Services. 

Personal data means all information relating to an identified or identifiable natural person such as your name, date of birth, address, or email address, and other as indicated further herein.

We encourage you to keep your personal information up-to-date and accurate. You can update your personal data at any time by accessing your account settings or contacting us directly.

If you are under 18 years of age, you must have parental consent before using our website or entering personal information. We do not intentionally collect any information from anyone under 13 years of age. Our website, products, and services are all directed to people who are at least 13 years of age or older.

To enable you to visit and use the Website

Purpose: To provide access to and functionality of the Website, enable user interactions, and ensure a secure and optimized user experience. This includes displaying user-generated content, analyzing website usage for improvements, and preventing abuse or unauthorized access. We also collect and use the data contained in log files. In other words, while visiting our website, certain information is automatically logged about how you are using it.

Personal data collected: 

  • Name, comment text (to display public feedback and interaction; please note that in this instance your email address is never shared or disclosed, but your name and comment will be visible to others)
  • Log files: IP address, ISP, browser type, visit time, visit pages (to analyse Website use and prevent abuse)
  • Cookies, usage data (to analyse website traffic and behaviour for optimization.)

Legal basis: The fulfilment of a contract (GTC) to which you are a party or in order to take steps at your request prior to entering into a contract (GTC) (Art. 6 (1) (b) of the GDPR), and compliance with the legal obligations to which beCreatives is subject (Art. 6 (1) (c) of the GDPR).

We collect and use your personal data for this purpose until your beCreatives account is deactivated or inactive for five (5) years.

To enable you to subscribe to our services or buy a product

Purpose: our services are subscription based, therefore for you to access most part of our content we ask you to subscribe, create a profile (account), as well as we process transactions occurring within the profile. We may need to administer the profile, ensure, track and account payments from within the profile.

Personal data collected: Name, username, email address, confirmation that you are aged over 18, password, payment details;

Legal basis: Legal basis for such collection and use of your personal data is our legitimate interest to enable you to set up your profile information (Art. 6 (1) (f) of the GDPR); and Article 6 (1) (b) (performance of a contract or necessary steps prior to entering into a contract);

We collect and use your personal data for this purpose until your beCreatives account is deactivated or inactive for five (5) years.

To send you personalized emails, newsletters, and promotional content

Purpose: if you choose to join our newsletter via any of the signup forms located on the Website or social media, the following data is required, so that we can send you our emails with a personalised note, occasionally email you about our products and special promotions that may be relevant to your interests.

Personal data collected: Name, email address

Legal basis: our legitimate interest in providing offers to our members (Art. 6 (1) (f) of the GDPR, Art. 13 (2) of Directive 2002/58/EC of the European Parliament and of the Council of July 12, 2002 regarding the processing of personal data and the protection of privacy in the electronic communications sector (Directive on privacy and electronic communications), Art. 81 (2) of Lithuanian Law on Electronic Communications). We base such collection and use on your consent (Art. 6 (1) (a) of the GDPR, Art. 81(1) of Lithuanian Law on Electronic Communications).

At the bottom of every email we send, you will find a link to unsubscribe: you may unsubscribe from the newsletter at any time by clicking on this link or sending us an email to [email protected] asking to be removed.

 We collect and use your personal data for this purpose until your beCreatives account is deactivated or inactive for five (5) years.

To provide you with customer support service

Purpose: If you send us a query, request, or want to appeal our decision, we will collect and use the following data for the purpose of providing you with customer support services you request on the Website / Platform.

Personal data collected:

  • Identification details: Name, email address, name of the business
  • Inquiry details: Any information you provide in your request, including descriptions of issues, feedback, or appeals
  • Technical data: Device information, browser type, operating system (if relevant to the inquiry)
  • Communication records: Chat transcripts, email exchanges, or support ticket history
  • Platform usage data: Relevant logs or actions taken on the Website/Platform (if required to resolve the issue)

The type of information we collect can vary depending on your inquiry, and on whether or not you have an account on our Website / Platform.

Legal basis: our legitimate interest to properly investigate your request, while the legal basis for the same in relation to users that have an account with us is the execution of the contract to which you have subscribed (GTC) (Art. 6 (1) (b) of the GDPR).

Personal data collected and used for this purpose are kept for 2 years after the last update related to your inquiry. If you have an account on our platform and it gets deleted, personal data collected and used for this purpose will be deleted along with your account, which may be shorter than 2 years.

To enable you to use the Platform and to improve your experience when using the Platform

Purpose: we collect and use your personal data in order to onboard you as a client and improve your experience when using the Platform by providing you relevant suggestions, third – party video, image, and article embedding, banners, posts, newsletters, and promotional content, and otherwise making the use of Platform more pleasant, improving the Platform itself;

Personal data collected: Name, email address, cookies, usage data and other (as per third-party policies, e.g. YouTube);

Legal basis: our legitimate interest in maintaining performance and improving the Platform and in ensuring that our members receive relevant suggestions and search results (Art. 6 (1) (f) of the GDPR)

We collect and use your personal data for this purpose until your beCreatives account is deactivated or inactive for five (5) years.

To analyse and output AI generated content for when the user uses the tool

Purpose: To process user inputs and generate AI-assisted content based on the provided data, ensuring the functionality and improvement of the AI tool while delivering relevant and personalized outputs to the user.

Personal data collected: Brand information, video transcriptions, Information submitted by the user to use the AI tool

Legal basis: The fulfilment of a contract (GTC) to which you are a party or in order to take steps at your request prior to entering into a contract (GTC) (Art. 6 (1) (b) of the GDPR);

We collect and use your personal data for this purpose until your beCreatives account is deactivated or inactive for five (5) years.

To conduct surveys

Purpose: We are always looking for ways to improve your user experience with beCreatives. As such, you may be invited to participate in a survey and your feedback may be used.

Personal data collected: User identification data, your gender, age, religion, and other qualifying data, your responses to our questions (e.g., your satisfaction with the Platform, your needs involving the Platform, problems that you encounter using the Platform and / or our Products)

The legal basis for inviting you to participate in the survey is our legitimate interest in receiving feedback from our members and using it to improve the Platform (Art. 6 (1) (f) of the GDPR, Art. 13 (2) of Directive 2002/58/EC of the European Parliament and of the Council of July 12, 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector (Directive on privacy and electronic communications), Art. 81 (2) of Lithuanian Law on Electronic Communications).

We collect and use your personal data for this purpose until your beCreatives account is deactivated or inactive for five (5) years. We will anonymize your responses after 1 (one) year – this means that the responses will no longer be associated with you.

For legal purposes

Purpose: We are handing your requests related to personal data, and complaints of any kind, as well as if you become involved in a dispute with beCreatives or we need to carry out enforcement of our GTC or otherwise defend, enforce, exercise and uphold our rights

Personal data collected: Name, email address, request / claim data, 

Legal basis: in order to comply with the legal obligations to which beCreatives is subject (Art. 6 (1) (c) of the GDPR) and on a legitimate interest to defend the rights and interests of beCreatives (Art. 6 (1) (f) of the GDPR).

Personal data collected and used for this purpose are kept for three (3) years from the day we respond to your request or until the dispute is resolved.

For recruitment purposes

If you decide to contact us for recruitment, we will process personal data submitted by you as a candidate for recruitment purposes or for purposes of purchasing services from freelancers. For details see below at “BeCreatives Recruitment Privacy Policy” section.

Personal data recipients

We transfer or share personal data with service providers only insofar as necessary and allowed in accordance with applicable laws. We transfer personal data to attorneys, attorney assistants, notaries, bailiffs, auditors, accountants, bookkeepers, debt collectors, consultants, translation agencies, IT service providers, insurance companies, and archiving services that provide services to beCreatives.

beCreatives is legally obligated to provide personal and/or usage data to investigative, criminal prosecution or supervisory authorities if and to the extent required to prevent risk to the public and for the prosecution of criminal acts.

Additionally, we share data within the beCreatives Group (see General part hereof).

You have the following rights with respect to your personal data:

Right of Access: You have the right to access your personal data processed by us. You can request information about the categories of data processed, the purposes of processing, the recipients of your data, and the retention periods.   

Right to Rectification: You can independently correct or update certain personal data in your profile. You may also request that we correct any inaccuracies in your personal data that we maintain. We may request documentation to support your request, particularly if it relates to changes impacting paid services.

Right to Erasure (“Right to be Forgotten”): In certain circumstances, you may request the deletion of your personal data. This right may apply where the data is no longer necessary for the purposes for which it was collected, you withdraw your consent, or you object to the processing.

We may, at your request, directly transfer your data to another controller where technically feasible.  

Right to Object to Automated Decision-Making: You have the right not to be subject to decisions based solely on automated processing, including profiling, that produce legal or similarly significant effects. If automated decision-making occurs, you have the right to obtain human intervention and to express your point of view.  

Right to Withdraw Consent: If you have given us consent to process your personal data, you have the right to withdraw that consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

beCreatives Recruitment Privacy Policy

If you decide to contact us for recruitment, we will process personal data submitted by you as a candidate for recruitment purposes or for purposes of purchasing services from freelancers.

The data controller for candidates applying to roles in Lithuania is Bcreatives, UAB, a legal entity (code 306321350) registered at Kintu st. 11, Vilnius, Lithuania.

For roles involving our U.S. entity, B.E. CREATIVES LLC may act as a data processor when handling specific aspects of candidate data, such as conducting background checks or administering assessments. B.E. CREATIVES LLC will process this data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), as applicable. 

Bcreatives, UAB remains the data controller for all candidate data, and B.E. CREATIVES LLC will process the data only as instructed by Bcreatives, UAB and under its supervision.

As Bcreatives, UAB is based in the European Union (Lithuania) and B.E. CREATIVES LLC is based in the United States, your personal information may be transferred between the two countries / continent. We will ensure that appropriate safeguards are in place to protect your personal information during these transfers, in compliance with applicable data protection laws.

During the recruitment process, we may collect the following categories of personal information:

  • Personal Identification Details: Full name, contact information, date of birth, and nationality.
  • Career and Educational Background: Resume details, cover letter, employment history, educational qualifications, and relevant skills.
  • Evaluation Information: Notes from interviews, candidate assessments, reference checks, and test results.
